Terms of Service

1. Introduction

Welcome to LawGo. These Terms of Service ("Terms") govern your access to and use of our AI-powered legal intelligence platform and related services (collectively, the "Service") provided by LawGo (Pty) Ltd ("we", "us", or "our"), a company registered in the Republic of South Africa.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Definitions

  • "User" means any individual or entity that accesses or uses the Service.
  • "Account" means your registered account to access the Service.
  • "Personal Information" means information as defined in the Protection of Personal Information Act 4 of 2013 (POPIA).
  • "Client Data" means any data, information, or content you upload, submit, or store using the Service, including documents, legal research, and AI-generated content.

3. Eligibility and Registration

To use our Service, you must be at least 18 years old and have the legal capacity to enter into binding contracts under South African law. By registering for an Account, you represent and warrant that all registration information you submit is truthful and accurate.

You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.

4. Use of the Service

4.1 Permitted Use

The Service is provided for lawful legal practice management purposes only. You may use the Service to manage legal matters, client information, documents, and communications, as well as AI-powered research, document automation, and legal analysis, in accordance with applicable laws and professional regulations.

4.2 Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Violate any applicable laws, including the Legal Practice Act 28 of 2014
  • Infringe upon the rights of others
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious software or harmful content

4.3 AI-Powered Features

Our Service includes AI-powered features such as legal research assistance, document analysis, and content generation. AI outputs are generated by third-party large language models and are provided as assistive tools only. You are solely responsible for reviewing, verifying, and validating all AI-generated content before relying on it for any legal or professional purpose. We do not guarantee the accuracy, completeness, or legal correctness of AI outputs.

Your Client Data, including documents and legal materials you upload or create, is never used to train AI models. Client Data is processed by AI models solely to provide you with the requested features and is not retained by AI providers beyond the immediate processing session.

5. Data Protection and POPIA Compliance

We are committed to complying with the Protection of Personal Information Act 4 of 2013 (POPIA). Our collection, processing, and storage of Personal Information is governed by our Privacy Policy, which forms part of these Terms. Where AI-powered features require cross-border data transfers for processing, we ensure adequate safeguards are in place as required by Section 72 of POPIA.

As a User processing Personal Information through our Service, you acknowledge that you are a "responsible party" under POPIA and are responsible for ensuring your use of the Service complies with POPIA and other applicable data protection laws.

5.1 AI Data Processing

To provide AI-powered features, your data may be processed by third-party AI providers including OpenAI, Anthropic, and Google. These providers act as operators (sub-processors) under our instruction and are contractually bound to process your data only as directed, maintain appropriate security measures, and not use your data for their own purposes including model training.

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by LawGo (Pty) Ltd and is protected by South African and international copyright, trademark, and other intellectual property laws.

You retain all rights to your Client Data. By using the Service, you grant us a limited license to host, store, and process your Client Data solely for the purpose of providing the Service. Your Client Data may be processed by AI models to deliver AI-powered features, but it is never used to train AI models.

6.1 AI-Generated Content

Content generated by AI features within the Service is provided to you for your use. You are responsible for ensuring that your use of AI-generated content complies with applicable laws, professional regulations, and ethical obligations. We make no representations regarding the intellectual property status of AI-generated content.

7. Fees and Payment

The Service is offered in multiple tiers, including a free tier, a Professional plan, and an Enterprise plan. Certain features of the Service may require payment of fees. All fees are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) where applicable. Payment terms will be specified at the time of purchase.

7.1 Service Tiers

The Service is offered in multiple tiers: a free tier with limited features, a Professional tier with enhanced capabilities, and an Enterprise tier with custom options. Feature availability, usage limits, and pricing for each tier are described on our pricing page and may be updated from time to time.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

THE SERVICE, INCLUDING ALL AI-GENERATED OUTPUTS, DOES NOT CONSTITUTE LEGAL ADVICE. AI OUTPUTS ARE PROVIDED AS ASSISTIVE TOOLS ONLY AND MUST BE INDEPENDENTLY REVIEWED AND VERIFIED BY A QUALIFIED LEGAL PROFESSIONAL. YOU SHOULD NOT RELY ON THE SERVICE OR ITS AI OUTPUTS AS A SUBSTITUTE FOR PROFESSIONAL LEGAL ADVICE.

9. Limitation of Liability

To the maximum extent permitted by South African law, LawGo (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless LawGo (Pty) Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. Upon termination, you will have thirty (30) days to export your Client Data. After this period, we may delete your data in accordance with our data retention policies.

Upon termination or cancellation of your Account, you will have thirty (30) days to export your Client Data. After this period, we may delete your data in accordance with our retention policies. We will provide reasonable assistance to facilitate data export upon request.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

13. Consumer Protection Act

Nothing in these Terms is intended to limit any rights you may have under the Consumer Protection Act 68 of 2008 (CPA) where applicable. If any provision of these Terms conflicts with the CPA, the CPA shall prevail.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website, updating the "Effective Date", and sending an email notification to registered users. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

16. Acceptable Use of AI Features

You agree not to use AI-powered features of the Service to: generate fraudulent, misleading, or deceptive legal documents; impersonate legal professionals; circumvent AI safety measures or content policies; process data that you do not have the right to process; or attempt to extract, reverse-engineer, or reconstruct the underlying AI models.

17. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our reasonable control. We will endeavour to provide advance notice of planned maintenance where possible.

18. Multi-Tenancy and Organisations

The Service supports multi-tenant organisations. Organisation administrators are responsible for managing user access, permissions, and compliance within their organisation. Each organisation's data is logically separated and not accessible to other organisations. Organisation administrators may have access to usage data and activity within their organisation as part of their administrative role.

19. Entire Agreement

These Terms, together with our Privacy Policy and any applicable plan-specific terms, constitute the entire agreement between you and LawGo (Pty) Ltd regarding your use of the Service. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
